Sexual battery reduced

Client was charged with Sexual Battery on a child under 12, which is punishable by Life in Prison in Florida. Client had no previous record. Attorney Holmberg adopted an agressive stance, electing to depose the victim, even though the State threatened that if the victim was deposed, they would not reduce the charges. The State started out asking for prison followed by probation. After the victim was deposed, the case was set for trial. Even though the State threatened not to reduce the charge if the case was set for trial, the Client ended up getting a plea offer of a reduction to a third degree felony (maximum penalty 5 years), probation and a withhold of adjudication. This resolution avoided the Client being classified as a sex offender subject to Florida's harsh registration requirements.
